Oil tycoon J. Howard Marshall's son, E. Pierce Marshall, promises to go back to a California federal court to keep the former Houston stripper from getting her hands on his father's billion dollar fortune.
On Monday, the US Supreme Court sided with Smith on a technicality, ruling only that federal courts do have jurisdiction in the case. Federal courts have mostly been favorable to Smith.
She says Marshall promised her millions of dollars before he died. She was 26 and he was 89 when they got married.
E. Pierce Marshall calls her a gold-digger. And he goes on to say in a statement:
"I will continue to fight to clear my name in California federal court. That is a promise that [Smith] and her lawyers can take to the bank."
